Terms of service
- You keep ownership of every 3D model and file you upload. You give us only the permission we need to run the service for you.
- We keep unpublished models confidential and never use your content to train AI models or in our marketing without your written permission.
- Only upload content you have the right to use. You are responsible for it.
- Anything you publish can be viewed by anyone with the link. Do not publish models you need to keep secret.
- Anyone can report illegal content to info@3dattract.com (section 9).
- The Services are for business and professional use, not for consumers. Standard, Pro and Guru subscriptions are sold through Link, a service of Stripe, as merchant of record (section 4).

1. Who we are
3D Attract is operated by 3D Attract Ltd, a company registered in the Bulgarian Commercial Register under UIC 208368629, VAT number BG208368629, registered address 24G General Ivan Kolev St., floor 6, apt. 20, Triaditsa district, 1407 Sofia, Bulgaria. Email: info@3dattract.com. The supervisory authorities for our activities include the Commission for Personal Data Protection and the Commission for Consumer Protection.
2. Scope and acceptance
These terms apply to the 3D Attract website, the Studio, published and embedded configurators, and our 3D services (together, the “Services”). By creating an account, accepting a quote or using the Services you agree to these terms on behalf of yourself and the organisation you represent, and you confirm you are authorised to do so and are at least 18.
The Services, including all paid plans, are only for businesses and professionals: companies, sole traders, freelancers and other organisations using them for their trade, business, craft or profession. By creating an account or buying a plan you confirm that you are acting for those purposes and not as a consumer. If you are nevertheless a consumer under the law that applies to you, the mandatory rights that law gives you are not affected by anything in these terms.
The contract is made when you create an account or, for a paid plan, when your payment is accepted; for custom work, when you accept our quote. You can correct your details before you submit them. You can save or print these terms at any time, and we can send you an earlier version on request. The contract is in English; we can also correspond in Bulgarian.
A signed quote, order or statement of work (an “Order”) may add specific terms. If it conflicts with these terms, the Order wins for that project.
3. Accounts
Give accurate details and keep them up to date. Keep your password secret, give each person their own login, and tell us straight away if you suspect someone has accessed your account. You are responsible for what happens under your account and for the people you invite to your workspace.
Teams, agencies and client workspaces
You can invite team members to your workspace. On the Guru plan an agency can also create client workspaces and invite its clients’ staff, with the permissions the agency chooses. The account holder who owns the workspace (for Guru, the agency) is our customer: it is responsible for the people it invites, the permissions it gives them, removing access when it is no longer needed, and the fees for client workspaces. Content in a client workspace is Your Content of the agency for the purposes of these terms; any agreement between the agency and its client about who owns that content, and whether it can be moved to the client’s own account, is between them. We move a client workspace away from an agency, for example to the client’s own account, only with the agency’s consent.
4. Plans, fees and payment
Plans, allowances and prices are shown on our pricing page or in your Order. Prices exclude VAT unless stated.
Paid plans are billed in advance, monthly or annually as you choose. Standard, Pro and Guru are bought through Link (see “Who sells the subscription” below); custom and managed projects are invoiced by us. We never see or store your full card details. Your plan renews automatically for the same period until you cancel, at the price that applies at renewal.
Free trial. Each company can use the Free trial free of charge for 14 days from when its workspace is created. No card is needed. When the trial ends, you can no longer create or change configurators until you choose a paid plan, but nothing is deleted: you can still see and delete your work, and configurators you already published keep working on your website (unless the account is later closed for inactivity, see section 11). Paid plans have no trial: you pay for the first period when you check out. One Free trial per company. We may refuse or close a trial that is a repeat or that was opened with false details. If a paid plan ends (because you cancelled or a payment failed), your account moves back to Free: the Free trial’s limits, without a new trial, so you can’t create or change configurators until you choose a paid plan again. Nothing is deleted (see “Moving to a smaller plan” below).
Annual billing. If you choose annual billing, you pay for 12 months in advance at the annual price shown on the pricing page, which is lower than 12 monthly payments. It renews for another 12 months unless you cancel before the renewal date.
You can cancel at any time in your account or by emailing info@3dattract.com. Cancellation takes effect at the end of the billing period you are in, and you keep full access until then. Fees already paid for a period are not refunded, except as set out under “Refunds” below.
Changing plans. Upgrades to a higher plan on the same billing period take effect immediately, and you pay only the difference for the rest of the current period. Switching from monthly to annual billing also takes effect immediately: a new 12-month period starts straight away, and you pay the annual price minus a credit for the unused part of your monthly period. Downgrades take effect at the end of the current period, so you keep what you paid for until then. On the Guru plan, an extra client workspace starts as soon as you add it, and you pay for the rest of the current period; removing one takes effect at the end of the period.
Failed payments. If a payment fails, Link will retry it for up to about two weeks and let you know. The Services keep working during that time. If the payment still fails, your plan ends and your account moves back to Free (see “Free trial” above). You can choose a paid plan again at any time.
Refunds. If you ask within 14 days of your first purchase of a paid plan, and no configurator has been published from your workspace since that purchase, we will arrange a full refund of that first payment. Email info@3dattract.com from the account owner’s address. Otherwise, fees already paid for the current period are not refunded, unless section 15 or our data processing agreement says so, Link gives a refund under its purchase terms, or the law requires it.
Before an annual plan renews, we or Link will email you a reminder with the renewal date and price. You can cancel online at any time in your account (Plan & billing) or in Link, without having to contact us.
If you reach a limit of your plan (for example the number of published configurators or the maximum model size), you can upgrade or remove content. We never charge for extra usage without your agreement. We may change prices for future periods with at least 30 days’ notice; the new price applies from your next renewal.
Moving to a smaller plan. If your account moves to a plan with lower limits, nothing you created is deleted. New work must fit the new plan’s limits. If you have more published configurators than the new plan allows, we may pause the extra ones (they stay in your workspace but are not shown on websites) until you upgrade or remove others, and the 3D Attract watermark may come back on plans that show it. We will tell you by email before we pause anything.
Fair use. Plans include a fair amount of configurator traffic for normal use on your own sites. If a configurator’s traffic is far above what is typical for your plan, we’ll contact you to agree an upgrade or a smaller model before anything changes. We never cut off a configurator without telling you first.
Who sells the subscription, taxes and invoices. Subscriptions to the Standard, Pro and Guru plans are sold to you by Sold through Link, LLC, a Stripe company (“Link”), which acts as reseller and merchant of record. It is shown as “Sold through Link” at checkout and as LINK.COM* 3D ATTRACT on your statement. Link’s purchase terms apply to the payment: Link takes the payment, adds VAT or sales tax where the law requires it, and sends your receipts and invoices. Questions about a charge or a receipt go to Link. To ask for a refund under “Refunds” above, email us. Link may also give refunds under its own policy, as well as any refund these terms or the law give you. 3D Attract Ltd provides the Services under these terms and remains responsible for them. Prices on our website exclude VAT unless stated. Custom and managed projects are sold and invoiced directly by 3D Attract Ltd; business customers in another EU country with a valid VAT number are invoiced without VAT under the reverse-charge rule.
Managed projects are billed as set out in the quote, normally a one-off setup fee plus a subscription. Unpaid invoices may lead to suspension after we have given you notice.
5. Your content and ownership
5.1 You keep ownership
“Your Content” means the 3D models, CAD files, textures, images, logos, product data, texts and configurations that you or your team upload or create in the Services. You keep all intellectual property rights in Your Content. Nothing in these terms transfers them to us.
5.2 The permission you give us
You give us a non-exclusive, worldwide, royalty-free licence to host, store, copy, convert, optimise, render, display and transmit Your Content, only as needed to provide, secure and support the Services for you, and to make your published configurators available where you choose to publish or embed them. Our subcontractors and hosting providers may do the same on our behalf. This licence ends when Your Content is deleted, apart from copies in backups, which are overwritten within the period stated in our privacy notice.
5.3 What we will not do
- We will not sell Your Content or give it to third parties except our service providers working for us.
- We will not use Your Content to train, fine-tune or improve AI or machine-learning models.
- We will not use Your Content, your name or your logo in our marketing or portfolio without your written permission.
5.4 Your promises about Your Content
You confirm that:
- you own Your Content or have all the licences and permissions needed to upload it and let us use it as described above;
- Your Content and its use in the Services do not infringe anyone else’s copyright, design rights, trade marks, patents, trade secrets or other rights, or break any confidentiality obligation you have;
- if Your Content shows or identifies real people (for example a body scan, a face, or a photo in a texture), you have their consent or another lawful basis;
- Your Content does not contain technical data whose export or sharing is restricted by export-control or sanctions law (for example EU dual-use or military items), unless we have agreed in writing how to handle it.
If someone makes a claim against us because Your Content breaks these promises, you will cover our reasonable losses and costs, provided we tell you promptly and let you take part in handling the claim. If you are a consumer, this applies only where you are at fault and only to losses that were foreseeable.
5.5 Feedback
If you send us suggestions about the Services, we may use them freely without owing you anything. This does not cover Your Content.
6. Confidentiality and publishing
We treat unpublished Your Content and any non-public information you share with us as confidential. Only our staff and subcontractors who need it to provide the Services or support can access it, and they are bound by confidentiality. We may disclose it if the law or an authority requires it, and will tell you where we lawfully can.
Published content is public. When you publish or embed a configurator, the 3D model, textures and settings are sent to every visitor’s browser so the model can be displayed. Anyone who can see it can view it from any angle, and a determined person may be able to capture or extract the displayed model. Do not publish models whose geometry or details you need to keep secret; use a simplified or lower-detail version instead. We are not responsible for copying of content that you chose to publish.
Your configurators and your shoppers
You are responsible for your configurators as they appear on your website or store: the products, options, prices, descriptions and images you set, and how you deal with shoppers’ quote requests and orders. You are the seller to your shoppers; we are not a party to any sale or quote between you and them. You are responsible for meeting the laws that apply to your shop, such as consumer, pricing, product-information and accessibility rules, and for giving your shoppers the privacy information the law requires (you can describe us as your service provider for configurators and quote requests).
Connections to Shopify, WooCommerce, Wix and other platforms are subject to those platforms’ own terms. If a platform changes or withdraws something we rely on, we will try to adapt, but we are not responsible for that platform.
7. Managed projects and 3D services
When we build a configurator, model, animation or optimisation for you, the scope, review rounds, timeline and price are set out in the quote. You will give us the files, information and feedback we need on time.
Unless the quote says otherwise, once you have paid in full you own the project-specific 3D models and images we create for you, and you receive a licence to use the configurator on our platform for as long as your subscription runs. We keep ownership of the 3D Attract platform, software, tools, templates, generic materials and know-how, which we may reuse in other work without using Your Content.
8. Acceptable use
You must not use the Services to:
- upload or publish anything illegal, or anything that infringes someone else’s rights;
- publish models, scans or likenesses of identifiable real people without their consent, or sexual, violent, hateful or harassing content;
- share designs or files for weapons, weapon parts or other items whose making or distribution is restricted by law;
- spread malware, phish, send spam, or mislead people about who you are or what you sell;
- try to access other customers’ data, test or bypass our security, or overload the Services;
- remove, hide or change the 3D Attract watermark or attribution on a plan that includes it;
- use the Services if you, or anyone owning or controlling you, are subject to EU, UK, US or UN sanctions, or are established in or acting for a person in a country where our providing the Services is restricted by sanctions (for example Russia or Belarus);
- copy, resell or reverse-engineer the Services, or use them to build a competing product, except where the law allows this regardless of these terms.
Open-source components we distribute, such as our WooCommerce plugin, are licensed under their own licences, which take priority over these terms for those components. Our WooCommerce plugin is licensed under the GNU General Public License, version 2 or later, and nothing in these terms restricts the rights that licence gives you.
9. Reporting illegal content
We host content uploaded by our customers. If you believe something on our Services is illegal or infringes your rights, email info@3dattract.com with the subject “Content report”. Please include:
- the exact web address (URL) of the content;
- why you believe it is illegal or infringing (for an IP complaint, what right you hold and how it is infringed);
- your name and email address (not needed if you report child sexual abuse material);
- a statement that you believe in good faith that the information in your report is accurate and complete.
We will confirm receipt, review the report promptly and carefully, and tell you what we decided. If we remove or restrict content, we tell the customer who uploaded it why, and they can ask us to reconsider by replying to that message. You can also use any out-of-court dispute settlement body certified under the EU Digital Services Act, or go to court.
How we moderate: we do not scan Your Content automatically. We act on reports and on what we notice ourselves; a person at 3D Attract reviews every case. Depending on the case we may restrict who can see the content, remove it, pause a published configurator, or suspend or close the account. We take into account the rights and interests of everyone involved, including freedom of expression. If we become aware of information suggesting a crime that threatens someone’s life or safety, we inform the relevant authorities.
Our single point of contact for authorities and for users under the Digital Services Act is info@3dattract.com. We can be contacted in English and Bulgarian.
Copyright notices and takedown (including the US DMCA)
If you believe content on our Services infringes your copyright, you can send a notice under the US Digital Millennium Copyright Act or the law that applies to you to our designated agent: 3D Attract Ltd, 24G General Ivan Kolev St., floor 6, apt. 20, 1407 Sofia, Bulgaria, info@3dattract.com (subject “Copyright notice”). Please include:
- your physical or electronic signature, as the copyright owner or a person authorised to act for them;
- the copyrighted work you say is infringed;
- the exact web address (URL) of the content you want removed;
- your name, postal address, telephone number and email address;
- a statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the law;
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act for them.
When we receive a complete notice we remove or disable access to the content promptly and tell the customer who uploaded it. If that customer believes the content was removed by mistake, they can send us a counter-notice with the same contact details, the content’s former address, a statement under penalty of perjury that it was removed by mistake or misidentification, and their consent to the jurisdiction of the courts where they are (or, outside the US, any court where we may be found). We pass the counter-notice to the person who sent the original notice and may restore the content after 10 to 14 working days unless they tell us they have gone to court. We close the accounts of customers who repeatedly infringe others’ rights. Sending a notice or counter-notice you know to be false can make you liable for damages.
10. Availability and changes
We work to keep the Services available and secure, but we do not promise uninterrupted service, and we may need maintenance windows. Features marked as preview, beta, “next” or “coming soon” may change or be removed. We may improve or change the Services; if a change significantly reduces what a paid plan includes, we will tell you in advance and you may cancel.
Please keep your own copies of your original files. The Services are not a backup service.
11. Suspension and termination
You can close your account at any time by emailing info@3dattract.com from the account owner’s address. We may suspend or close an account, or remove content, if you seriously or repeatedly break these terms, do not pay, if providing the Services would break sanctions law, or if the law or a risk to others requires it. Where reasonable we will warn you first and explain why.
If an account has no paid plan and nobody has signed in for 24 months, we may close it. We will email the account owner at least 30 days before, and you can keep it by signing in.
After your account closes you have 30 days to export Your Content. We delete Your Content and your account within 90 days of closure, and backup copies are overwritten within a further 30 days. Published configurators stop working when the account closes.
Switching to another provider
You can end your plan at any time to move to another provider or to your own systems. When you tell us you want to switch, we will help you for a transition period of up to 30 days (longer if we agree), during which the Services keep working. You can export Your Content: your uploaded files, converted models, textures, configuration settings and project data, in the formats the Studio offers. After the transition period you have a further 30 days to retrieve your data, and then we delete it as described above. We do not charge for switching or exporting. Our services run in the EU (Frankfurt) and the United Kingdom (London); see our privacy notice for details.
12. Warranties and liability
We provide the Services with reasonable skill and care. Apart from that and from anything the law does not allow us to exclude, the Services are provided “as is”, and we do not promise they will suit every purpose or that 3D conversions will be identical to your source files.
Neither of us is liable to the other for indirect or consequential loss, or for lost profits, revenue, data or goodwill. Each party’s total liability under these terms in any 12 months is limited to the fees you paid us in those 12 months (or EUR 1,000 if that is higher). These limits do not apply to liability for intent or gross negligence, death or personal injury, your payment obligations, or your promises and responsibility under section 5.4, and they do not limit anything the law does not allow to be limited.
Neither of us is responsible for delays or failures caused by events beyond our reasonable control, such as failures of the internet, our hosting providers or power, war, or government action, provided we tell the other promptly and do what we reasonably can to limit the effect.
13. Data protection
Our privacy notice explains how we use personal data as a controller. When we process personal data on your behalf, including personal data in Your Content and in quote requests from your shoppers, our data processing agreement applies and forms part of these terms.
14. Law and disputes
These terms are governed by Bulgarian law. If you are a consumer, this does not take away the protection given to you by the mandatory law of the country where you live. Before going to court, we will both try to settle the dispute by talking in good faith. The courts in Sofia, Bulgaria, have jurisdiction, but if you are a consumer you can also go to court where you live, and we can only take you to court there.
If you are a consumer, you can also use an out-of-court dispute settlement body. In Bulgaria this is the General Conciliation Commission for consumer disputes at the Commission for Consumer Protection (www.kzp.bg).
15. General
We may update these terms to reflect changes to the Services, the law or our business. We will give you at least 30 days’ notice by email or in your account before material changes take effect, and explain them. If you do not agree, you can cancel before the change takes effect, and if you prepaid we will refund the unused part of your current period. Changes needed only to comply with the law may take effect sooner.
We send notices to the email address of the account owner. You can send notices to info@3dattract.com.
You may not transfer your account without our consent; we may transfer these terms to a company that takes over our business. If a part of these terms is invalid, the rest still applies. These terms, any Order and the documents they refer to are the whole agreement between us about the Services.
